1. Introduction

This Acceptable Use Policy (AUP) outlines the rules for using Berican Labs hosting services. By using our services, you agree to comply with this policy. Violations may result in suspension or termination of your account.

2. Prohibited Content

You may not host, distribute, or link to content that:

2.1 Illegal Content

  • Violates any applicable Kenyan or international laws
  • Infringes on intellectual property rights
  • Contains child exploitation material
  • Facilitates illegal activities

2.2 Harmful Content

  • Contains malware, viruses, or malicious code
  • Phishing pages or credential harvesting
  • Promotes violence or terrorism
  • Harasses, threatens, or defames individuals
  • Contains hate speech or discrimination

2.3 Adult Content

  • Pornographic or sexually explicit material
  • Content depicting non-consensual acts

Note: Age-verified adult content may be permitted on Business and Enterprise plans with prior approval.

2.4 Deceptive Content

  • Fraudulent schemes or scams
  • Fake reviews or testimonials
  • Impersonation of individuals or brands
  • Misleading health or financial claims

3. Prohibited Activities

You may not use our services to:

3.1 Security Violations

  • Attempt unauthorized access to systems or data
  • Conduct port scanning or vulnerability testing
  • Distribute hacking tools or exploit code
  • Interfere with other users' services

3.2 Network Abuse

  • Send spam or unsolicited bulk email
  • Conduct DDoS attacks or participate in botnets
  • Run open proxies or anonymization services
  • Operate TOR exit nodes
  • Mine cryptocurrency

3.3 Resource Abuse

  • Exceed fair use of shared resources (CPU, memory, bandwidth)
  • Run resource-intensive background processes
  • Use services for file storage or backup not related to web hosting

4. Email & Communication

When using email services:

  • Comply with anti-spam laws
  • Only send to opted-in recipients
  • Include unsubscribe link
  • Max 500 emails/hour

5. API & Automation

When using our API:

  • Respect rate limits
  • No security circumvention
  • No unauthorized scraping
  • Use appropriate user-agents

If you discover a violation:

Upon discovering a violation, we may:

7.1 First Offense (Minor)

  • Warning notice (24-48h to resolve)
  • Temporary feature restriction

7.2 Repeated/Serious

  • Immediate suspension
  • Content removal
  • Account termination
  • No refund

7.3 Severe Violations

  • Immediate termination
  • Report to law enforcement
  • Legal action for damages

8. Appeal Process

If suspended in error:

9. Fair Use Guidelines

Shared hosting limits:

  • CPU: Max 25% of shared CPU
  • Memory: 512MB per process
  • Storage: Active website files only

10. Cooperation

We cooperate with law enforcement:

  • Valid court orders
  • Data preservation
  • Reporting illegal content

11. Changes to This Policy

We may update this policy at any time. Material changes will be communicated via email. Continued use of services after changes constitutes acceptance.
