Version 2.01. Agreement to Terms
By accessing or using Berican Labs services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.
2. Description of Services
Berican Labs provides web hosting services including but not limited to:
- •Static website hosting
- •WordPress hosting
- •Domain registration and management
- •SSL certificate provisioning
- •Content Delivery Network (CDN) services
- •API and developer tools
3. Account Registration
To use our services, you must create an account. You agree to:
- •Provide accurate and complete information
- •Maintain the security of your account credentials
- •Notify us immediately of any unauthorized access
- •Accept responsibility for all activities under your account
4. Acceptable Use
You agree not to use our services to:
- •Violate any applicable laws or regulations
- •Infringe on intellectual property rights
- •Distribute malware or engage in hacking activities
- •Send spam or unsolicited communications
- •Host content that is illegal, harmful, or offensive
- •Attempt to gain unauthorized access to our systems

5. Payment Terms
Payment is required for all paid services. We accept:
- •MPESA (mobile money)
- •Credit and debit cards (Visa, Mastercard)
- •Bank transfers (for annual plans)
Subscriptions automatically renew unless cancelled. Refunds are available within 14 days of initial purchase as per our refund policy.
6. Service Level Agreement
We commit to a 99.9% uptime guarantee for paid plans. See our SLA for details on credits and remedies for service disruptions.
7. Data and Privacy
Your use of our services is also governed by our Privacy Policy. You retain ownership of your content. We will not access your content except as necessary to provide services or comply with legal obligations.
8. Intellectual Property
Berican Labs and its original content, features, and functionality are owned by Berican Labs and protected by international copyright, trademark, and other intellectual property laws.
9. Termination
We may terminate or suspend your account at any time for violation of these terms. Upon termination:
- •Your right to use services immediately ceases
- •You may download your data within 30 days
- •No refunds for remaining subscription period
10. Limitation of Liability
To the maximum extent permitted by law, Berican Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services.
11. Indemnification
You agree to indemnify and hold harmless Berican Labs from any claims, damages, or expenses arising from your use of services or violation of these terms.
12. Governing Law
These terms shall be governed by the laws of Kenya. Any disputes shall be resolved in the courts of Nairobi, Kenya.
13. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of material changes via email or through our website. Continued use after changes constitutes acceptance of new terms.
